Welcome to Public Safety Direct (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your access to and use of our services, including but not limited to our website, mobile applications, text messaging services, vehicle upfitting, equipment installation, consulting, and any other products or services (collectively, the “Services”).By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that you meet this requirement.

2. Use of Services You agree to use our Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the Services for any illegal, harmful, or abusive activities, including but not limited to:

• Interfering with the security or integrity of the Services
• Impersonating another person or entity
• Violating the rights of others, including privacy and intellectual property rights

3. Text Message Communications By providing your phone number to Public Safety Direct, you consent to receive text messages (SMS and MMS) from us for informational and operational purposes, including but not limited to:

• Updates regarding the status of your account
• Updates regarding the status of your vehicle or services

You understand that consent to receive marketing text messages is not required as a condition of using our services. Message and data rates may apply depending on your mobile plan. Message frequency may vary. 

Opt-Out: You may opt out of receiving promotional text messages at any time by replying “STOP” to any message. You may receive a final confirmation message after opting out. For help, reply “HELP” or contact us at Sales@publicsafetydirect.com or 708-389-1896.

4. Intellectual Property All content and materials on the Services, including logos, text, graphics, software, and other intellectual property, are owned by or licensed to Public Safety Direct and are protected by applicable laws. You may not reproduce, distribute, or create derivative works without our express written permission.

5. Services, Equipment, and Warranties Public Safety Direct provides equipment sales, installation, integration, and related services.

• All equipment is subject to manufacturer warranties where applicable.
• Public Safety Direct does not provide additional warranties unless expressly stated in writing.
• Customers are responsible for proper use and maintenance of all equipment after installation.
• Public Safety Direct is not responsible for failures caused by misuse, modification, or third-party components.

6. Payment Terms Payment terms are as stated on invoices or agreements. Public Safety Direct reserves the right to:

• Require deposits prior to work
• Withhold delivery of equipment or vehicles until payment is made
• Charge late fees on overdue balances
• Suspend or terminate services for non-payment
• 
  

7. Delays and Service Interruptions Public Safety Direct is not responsible for delays caused by supply chain issues, manufacturer availability, scheduling constraints, weather, or other circumstances outside our control.

8. Vehicle Storage & Risk of Loss Vehicles left at Public Safety Direct facilities are stored at the owner’s risk. Public Safety Direct is not responsible for damage caused by events outside of our control, including but not limited to:

• Hail, storms, wind, flooding, or other weather-related events
• Fire, theft, or vandalism
• Acts of God or unforeseen incidents

Customers are responsible for maintaining appropriate insurance coverage for their vehicles and equipment while in our possession.

9. Termination We reserve the right to suspend or terminate your access to the Services at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business interests.

10. Disclaimers and Limitation of Liability The Services are provided “as is” and “as available” without warranties of any kind. Public Safety Direct disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law:

• Public Safety Direct’s total liability shall not exceed the amount paid for the specific services or products giving rise to the claim.
• Public Safety Direct shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of revenue, or vehicle downtime.

11. Indemnification You agree to indemnify, defend, and hold harmless Public Safety Direct from any claims, damages, or liabilities arising out of:

• Misuse of products or services
• Modifications to installed equipment
• Operation of vehicles after service
• Violation of these Terms

12. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Illinois. Any disputes shall be resolved in the appropriate courts located within Illinois.13. Changes to These Terms We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on our website or through the Services. Continued use of the Services constitutes acceptance of those changes.
